HIPAA Notice of Privacy Practices

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

MHMNUTRA LLC, a Delaware limited liability company, operating clearpathcompounds.com ("Clearpath Compounding", "we", "us", "our"), is committed to protecting the privacy of your health information. This Notice of Privacy Practices ("Notice") explains how we may use and disclose your protected health information ("PHI") and your rights regarding that information, in accordance with the Health Insurance Portability and Accountability Act of 1996, as amended ("HIPAA").

1. Our Pledge Regarding Your Health Information

We understand that health information about you is personal. We are committed to protecting your PHI. We are required by law to:

  • Maintain the privacy of your PHI
  • Provide you with notice of our legal duties and privacy practices
  • Notify you in the event of a breach affecting your unsecured PHI
  • Abide by the terms of the Notice currently in effect

2. How We May Use & Disclose Your Health Information

We may use and disclose your PHI without your specific authorization for the following purposes:

Treatment

We may share your PHI with licensed healthcare providers, including affiliated telehealth providers and dispensing pharmacists, to evaluate, prescribe, prepare, dispense, and counsel you regarding your medication.

Payment

We may use and disclose your PHI to obtain payment for services we provide. This includes activities such as billing, claims management, and collection.

Healthcare Operations

We may use and disclose your PHI in connection with our healthcare operations, including quality assessment, provider performance evaluation, accreditation, audits, and customer service.

Required by Law

We will disclose PHI when required to do so by federal, state, or local law — including in response to court orders, subpoenas, public health reporting requirements, and law enforcement requests.

Health & Safety

We may disclose PHI to prevent or lessen a serious and imminent threat to the health or safety of a person or the public.

Business Associates

We may share PHI with vendors who perform services on our behalf (such as IT hosting, electronic prescribing platforms, and customer support tools), under contracts that require them to safeguard your PHI.

3. Uses Requiring Your Authorization

Other uses and disclosures of your PHI not described above will be made only with your written authorization. You may revoke an authorization in writing at any time, except to the extent we have already acted in reliance on it.

The following always require your written authorization:

  • Most uses and disclosures of psychotherapy notes
  • Uses and disclosures of PHI for marketing
  • Sale of your PHI

4. Your Rights Regarding Your Health Information

You have the following rights with respect to your PHI:

  • Right to Inspect & Copy. You may request access to your PHI maintained by us.
  • Right to Amend. You may request that we correct PHI you believe is inaccurate or incomplete.
  • Right to an Accounting of Disclosures. You may request a list of certain disclosures we have made of your PHI.
  • Right to Request Restrictions. You may request restrictions on how we use or disclose your PHI. We are not required to agree to most restrictions, except restrictions on disclosures to a health plan for items you paid for in full out of pocket.
  • Right to Request Confidential Communications. You may request that we contact you in a specific way (e.g., only by email).
  • Right to a Paper Copy of This Notice. You may request a paper copy at any time.
  • Right to Notification of a Breach. You have the right to be notified of any breach of your unsecured PHI.

5. Complaints

If you believe your privacy rights have been violated, you may file a complaint with us by emailing help@clearpathcompounds.com, or with the U.S. Department of Health and Human Services, Office for Civil Rights. We will not retaliate against you for filing a complaint.

6. Changes to This Notice

We reserve the right to change this Notice at any time, and the changes will apply to all PHI we maintain. The "Last Updated" date at the top will reflect the most recent revision. The current version of this Notice will be posted on our website.
